Hello everyone!
As we all know, Houston roads can be unpredictableāand accidents happen every day. This week, we want to touch on what you can expect if youāre at fault in an accident and donāt have insurance, also known as being an uninsured motorist in Houston.
To begin with, at the scene of the accident, the police will give you a ticket for no insurance, along with a court date. This triggers the legal consequences we discussed in our previous article on traffic violations.
After the accident, the other driver will file a claim with their own insurance company to cover their injuries (if any) and vehicle repairs. Once their damages are resolved and totaledāletās say it adds up to $33,000ātheir insurance company will notify the Texas Department of Motor Vehicles (DMV).
At that point, the DMV will send you a letter stating that you have 20 days to do one of the following:
-
Show proof you had insurance on the day of the accident
-
Pay the $33,000
-
Enter a contract with the other partyās insurance company to pay them back
If youāre unable to pay or enter a payment plan, the DMV will suspend your driverās license and all vehicle registrations under your name. The letter will also give you the option to request a hearing to prove that you were not at fault in the accident.
If you donāt comply with these requests, your driverās license and vehicle registrations will be suspendedāadding even more complications to an already stressful situation.
As you can see, this can turn into a real nightmare fast. Thatās why we strongly recommend maintaining liability insurance at all times. But if you find yourself in a similar situation, donāt panicāreach out to us.
